Pointing out that the negotiations took about the entire period of his tenure as Minister to achieve, the Minister added that the successful negotiation was able to free up another N39.17Billion held under another Judgement in court to be used now for the supply of electricity metres to the Discos.

The BPP argued that, in awarding the contract to the 1st plaintiff (J.K.Gadzama LLP), the 2nd defendant (BPE) violated existing laws, more so, when it was not the nature of contracts that involved national security or defence to warrant it from being exempted from the application of the PPA 2007.

It specifically noted its disappointment that electricity Distribution Companies (Discos) which took over from the erstwhile Power Holding Company of Nigeria (PHCN) are performing worse than their predecessors.

“The House was also concerned that the lofty goals of privatisation was marred by the sale of the sector to preferred bidders that could not pay the bid value on the sale, instead the BPE encouraged the deferment of payment and restructuring of payment terms in contravention of bidding rules to the disadvantage of other bidders.”
